Welcome to Myconiq. These Terms of Service ("Terms") govern your use of the Myconiq fitness platform ("Platform", "Service", "App"), operated by Sonami Holding BV, a company registered in the Netherlands. By accessing or using Myconiq, you agree to be bound by these Terms.

Myconiq provides workout programs, exercise tracking, and fitness content to help you achieve your health and fitness goals. Please read these Terms carefully before using our Service.

2. Service Description

Myconiq provides:

• Workout Programs: Structured fitness programs designed for various goals and experience levels.
• Exercise Library: Video demonstrations and instructions for exercises.
• Progress Tracking: Tools to track completed workouts, achievements, and fitness progress.
• Health Integration: Optional connection to Apple Health and Google Health Connect.
• Community Features: Leaderboards and social fitness features.

Myconiq does not provide medical advice, diagnosis, or treatment. The workout content is for informational and educational purposes only. You participate in workouts at your own risk.

4. Eligibility

To use Myconiq, you must:

• Be at least 16 years old, or have parental/guardian consent if between 13-16
• Provide accurate and truthful information
• Have the legal capacity to enter into these Terms
• Not be prohibited from using the Service under applicable laws

5. User Accounts

Account Creation

• You must create an account to access Myconiq features
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized use of your account
• You are responsible for all activities that occur under your account

Account Termination

We reserve the right to suspend or terminate your account for violation of these Terms, abusive behavior, or any other reason at our reasonable discretion. You may delete your account at any time through the app settings.

6. Subscriptions and Payments

Free and Premium Features

Myconiq offers both free features and premium subscription plans. Premium features require an active subscription.

Subscription Terms

• Subscriptions are billed through the Apple App Store or Google Play Store
• Subscriptions automatically renew unless cancelled before the renewal date
• Prices may vary by region and are displayed in your local currency
• Free trial periods, if offered, convert to paid subscriptions unless cancelled

Cancellation and Refunds

• Cancel subscriptions through your App Store or Play Store settings
• Cancellation takes effect at the end of the current billing period
• Refunds are handled according to Apple or Google's refund policies
• No refunds for partial subscription periods

7. User Responsibilities

When using Myconiq, you agree to:

• Use the Service only for personal, non-commercial fitness purposes
• Provide accurate information about yourself and your fitness level
• Exercise safely and within your physical capabilities
• Not share your account credentials with others
• Not attempt to reverse engineer, copy, or redistribute the app or its content
• Not use the Service to harass, abuse, or harm others
• Respect the intellectual property rights of Myconiq and third parties

8. Intellectual Property

The Myconiq platform, including its design, features, workout content, videos, images, and branding, is owned by Sonami Holding BV and protected by intellectual property laws. You may not:

• Copy, modify, or distribute any part of the platform without permission
• Record, download, or redistribute workout videos
• Use automated systems to access the platform without authorization
• Use the Myconiq name or branding without written consent
• Create derivative works based on our content

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• Myconiq does not provide medical advice. We are a fitness platform, not a healthcare provider.
• We are not responsible for injuries that may occur while following workout programs. You exercise at your own risk.
• We do not guarantee specific results. Individual fitness results vary based on many factors.
• We are not liable for service interruptions, data loss, or technical issues beyond our reasonable control.

Our total liability for any claim arising from your use of Myconiq shall not exceed the amount you paid to us in the 12 months preceding the claim, or €100, whichever is greater.

10. Disclaimer of Warranties

Myconiq is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the service will be uninterrupted or error-free
• Warranties regarding the accuracy of calorie or fitness calculations
• Warranties regarding achieving specific fitness goals

11. Indemnification

You agree to indemnify and hold harmless Myconiq, Sonami Holding BV, and their officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform, violation of these Terms, or infringement of any third-party rights.

12. Privacy

Your use of Myconiq is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data in accordance with GDPR.

13. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Your continued use of Myconiq after such changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you should stop using the Service.

14. Governing Law and Disputes

These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms or your use of Myconiq shall be subject to the exclusive jurisdiction of the courts in Amsterdam, the Netherlands.

For consumers in the European Union: Nothing in these Terms affects your statutory rights under applicable consumer protection laws. You may also have the right to bring claims in your country of residence.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Myconiq regarding the use of the Service and supersede any prior agreements.
